Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Getmesoon and govern your access to and use of the Getmesoon mobile application, websites and related services (the “Service”). Please read them carefully.

1. Eligibility

  • You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to use the Service. Getmesoon is a dating service exclusively for adults.
  • You must have the legal capacity to enter into a binding contract and must not be barred from using the Service under applicable law.
  • You must not have been previously banned from the Service or convicted of a serious violent or sexual offence.
  • By using the Service, you represent and warrant that you meet all of these eligibility requirements.

2. Your account

  • You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
  • You are responsible for all activity that occurs under your account. Notify us immediately at [SUPPORT EMAIL] if you suspect unauthorised use.
  • You may not create more than one account, create an account on behalf of someone else, or transfer your account to another person.

3. Acceptable use and prohibited conduct

You agree to use the Service lawfully and respectfully, and to follow our Community Guidelines. You must not:

  • Impersonate any person, create fake or misleading profiles, or misrepresent your age or identity.
  • Harass, threaten, defame, stalk, abuse or intimidate other users.
  • Post or share content that is unlawful, hateful, sexually explicit (where prohibited), violent, or otherwise violates our guidelines.
  • Solicit money, engage in scams, fraud, “romance scams”, or commercial or promotional activity without our permission.
  • Use the Service to engage in prostitution, trafficking, or any illegal activity.
  • Collect or harvest other users' data, use bots or automated tools, or attempt to circumvent security or moderation systems.
  • Upload viruses or malicious code, or interfere with the proper working of the Service.

We may investigate and take action against any suspected violation, including removing content, suspending or terminating accounts, and reporting to law enforcement.

4. Subscriptions, in-app purchases and auto-renewal

  • The Service may offer paid subscriptions and one-time in-app purchases (“Paid Features”). Prices and features are described at the point of purchase.
  • Purchases made through the Apple App Store or Google Play are processed by those platforms and are subject to their respective terms and policies. Where required, billing is handled by Apple or Google rather than directly by us.
  • Auto-renewal: Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the period.
  • Managing and cancelling: You can manage or cancel auto-renewal in your Apple App Store or Google Play account settings. Deleting the app does not cancel a subscription.

5. Refunds

Payments are generally non-refundable except where required by applicable law. Because purchases are processed by the app stores, refund requests are typically handled under the policies of the Apple App Store or Google Play, and you may need to request a refund directly from them. Where you purchased directly from us, contact [SUPPORT EMAIL]. Statutory rights that cannot be excluded by law are not affected.

6. User content and licence

  • You retain ownership of the photos, text and other content you submit to the Service (“User Content”).
  • You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, display and distribute your User Content solely for the purpose of operating, providing, improving and promoting the Service, consistent with our Privacy Policy. This licence ends when you delete your User Content or account, except for copies retained for legal or backup purposes.
  • You represent that you have the rights to your User Content and that it does not violate the rights of others or any law.

7. Safety disclaimer

Getmesoon does not conduct criminal background checks or identity verification on all users. Verification features reduce, but do not eliminate, the risk of encountering bad actors. You are solely responsible for your interactions with other users, both online and in person. We do not guarantee the conduct, identity or compatibility of any user. Please review our Safety Tips and exercise caution, especially when meeting someone for the first time. We are not responsible for the conduct of any user.

8. Termination

  • You may stop using the Service and delete your account at any time through the app (Settings > Account > Delete Account) or via our Data Deletion page.
  • We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or our guidelines, or to protect the Service or other users.
  • Provisions that by their nature should survive termination (including licences for retained content, disclaimers, limitations of liability, and dispute resolution) will continue to apply.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that you will find a match or compatible person.

10. Limitation of liability

To the maximum extent permitted by applicable law, Getmesoon and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other intangible losses, arising from or relating to your use of (or inability to use) the Service, including any interactions with other users. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) INR 5,000 (or the equivalent in your local currency). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnity

You agree to indemnify, defend and hold harmless Getmesoon and its affiliates from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, your interactions with other users, or your breach of these Terms or applicable law.

12. Governing law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. Subject to the dispute resolution provisions below, the courts at [CITY, INDIA — e.g., the courts of the city of your registered office] will have exclusive jurisdiction.

13. Dispute resolution and arbitration

Most concerns can be resolved quickly by contacting [SUPPORT EMAIL]. If a dispute cannot be resolved informally, it will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 of India. The arbitration will be conducted by a sole arbitrator appointed by us, the seat and venue of arbitration will be [CITY, INDIA], and the proceedings will be conducted in English. The arbitrator's award will be final and binding. Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court.
